[cabfpub] Question regarding Business Entity subjects

I've always thought the answer was "no" to this question, but I'm rethinking
my position. The requirements are in 8.5.4:

 

(1) The entity is a legally recognized entity that filed certain forms with
a Registration Agency in its jurisdiction, the Registration Agency issued or
approved the entity's charter, certificate, or license, and the entity's
existence can be verified with that Registration Agency;

- Check.  Each of these have a license that is verifiable in the
jurisdiction of registration.

 

(2) The entity has a verifiable physical existence and business presence;

- Check.  Most of these entities have publicly registered addresses and
physical presences. 

 

(3) At least one Principal Individual associated with the entity is
identified and validated by the CA;

- Easy enough to do.

 

(4) The identified Principal Individual attests to the representations made
in the Subscriber Agreement;

- Easy enough to do.

 

(5) the CA verifies the entity's use of any assumed name used to represent
the entity pursuant to the requirements of Section 11.3 herein;

- Easy enough to do.

 

(6) The entity and the identified Principal Individual associated with the
entity are not located or residing in any country where the CA is prohibited
from doing business or issuing a certificate by the laws of the CA's

jurisdiction; and

- Probably easier for these entities than most organizations

 

(7) The entity and the identified Principal Individual associated with the
entity are not listed on any government denial list or prohibited list
(e.g., trade embargo) under the laws of the CA's jurisdiction.

- Check.

All,

Does a licensed professional operating as a sole proprietor qualify for EV
as a Business Entity assuming we can verify the license through the proper
government authority?

Examples:

Attorney

Chartered accountant/CPA

Licensed plumber or electrician

General contractors

Etc.

 

The Guidelines do mention sole-proprietors as Business Entities, so my only
real question is whether or not a professional license issued by the
appropriate government authority establishes legal existence under section
11.
