Here is a draft ballot that would reduce and simplify the insurance requirements in section 8.4 of the EV Guidelines. It would:

1-     eliminate the $2 million commercial general liability insurance requirement and replace it with ordinary casualty insurance (in whatever amount would be sufficient to repair CA systems);

2-     replace third party coverage of $5 million US (nearly €3.7 million) with a €2 million amount (a 46% reduction);

3-     eliminate certain types of third party insurance that might be hard to obtain in various jurisdictions, such as professional liability, contractual liability, technology E&O, IP infringement, invasion of privacy, and advertising injury;

4-     increase the number of potential insurers that CAs can use (any rated "good" by any well-recognized insurance rating service);

5- clarify that insurance must be global and cover the lifetimes of EV certificates issued; and

6- only recommend that a CA obtain additional insurance for damage to data or systems due to IT security failure, if such is available to the CA at reasonable cost.

I'm looking for additional comments and endorsers, and then I will add this to next week's agenda.

Thanks,

Ben
