In other words, the Chair does not have a decision to make. The PAG is an ad-hoc group constituted specifically in relation to the Final Guideline or Final Maintenance Guideline containing the conflict. A PAG may also be formed without such a disclosure if a PAG could help avoid anticipated patent problems.” Prior to this proposed amendment it was too difficult for a PAG to evaluate assertions of “Essential Claim” because Section 4.3 allowed general assertions. With the proposed amendment to Section 4.3, the Participant must identify the numbered section of the guideline that they assert contains an Essential Claim.
